Terms of Service

These Terms govern your use of PestaKita (the “Platform”), operated by PT PestaKita Hiburan Nusantara (“PestaKita”, “we”, “us”). By creating an event, buying a ticket, or otherwise using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.
1.Our role — we are an intermediary, not the organizer
PestaKita is an electronic ticketing platform — an Electronic System Operator (Penyelenggara Sistem Elektronik) under Government Regulation No. 71 of 2019 (PP 71/2019) and Minister of Communications Regulation No. 5 of 2020 (Permenkominfo 5/2020). We provide the tools to list events, sell tickets via QRIS, and validate entry.
We are notthe organizer, promoter, venue, or seller of any event listed on the Platform. Each event is created and run solely by an independent “Host”. The Host — not PestaKita — is fully and solely responsible for the event, its legality, its permits, and everything that happens at it.
2.Definitions
- Host — the account that creates and operates an event and sells tickets.
- Attendee — anyone who buys or holds a ticket.
- Event — any listing created on the Platform.
- Ticket — the QR-based entry credential issued after payment.
3.Eligibility & age
- Hosts must be at least 18 years old and legally competent to enter into a contract (cakap hukum under the Indonesian Civil Code / KUHPerdata).
- Attendees must meet the minimum age set for each event. Any event that serves alcoholic beverages is restricted to persons aged 21 and over, consistent with Minister of Trade Regulation No. 20 of 2014 (Permendag 20/2014) and its amendments.
- Age is confirmed by the Host at the door. The Host (and the venue) is responsible for checking valid government ID and refusing entry to anyone who does not meet the age requirement.
4.Host obligations & warranties
By creating an event, the Host represents, warrants, and agrees that:
- The event complies with all applicable Indonesian laws and regulations, including but not limited to the Electronic Information and Transactions Law (UU 11/2008 as amended by UU 19/2016 and UU 1/2024), the Consumer Protection Law (UU 8/1999), the Narcotics Law (UU 35/2009), the Pornography Law (UU 44/2008), and applicable public-order rules.
- The Host holds all required permits and licenses before publishing, including the police crowd/event permit (Izin Keramaian), the venue’s tourism business registration (TDUP / NIB), and — where alcohol is served — a valid alcohol sale licence.
- All event information is accurate and not misleading.
- The Host will honor every valid ticket and run the event as described, or refund Attendees if it is cancelled or materially changed.
- Taxes.The Host is solely responsible for all taxes arising from the event, including income tax (PPh) and any local entertainment / certain-goods-and-services tax (PBJT under UU 1/2022 on Fiscal Relations / HKPD, or applicable local regulations). PestaKita does not collect or remit the Host’s taxes. PestaKita may request the Host’s NPWP and identity documents at any time — including as a condition of payout — and may withhold payouts until they are provided.
5.Alcohol & controlled substances
- Alcohol may only be sold or served where the Host/venue is licensed to do so, only to persons 21+, and never to minors or visibly intoxicated persons, in line with Permendag 20/2014.
- Narcotics and illegal drugs are strictly prohibited (UU 35/2009). PestaKita has zero tolerance and will cooperate fully with law enforcement.
6.Prohibited events
You may not create, promote, or sell tickets to any event that:
- Lacks the required permits or licenses, or violates any law or local regulation.
- Involves or promotes illegal drugs, prostitution, illegal gambling (judi), human trafficking, weapons, violence, or terrorism.
- Serves alcohol without a licence, or serves alcohol to minors.
- Contains pornography (UU 44/2008) or content that incites hatred based on ethnicity, religion, race, or group (SARA).
- Is fraudulent, oversells capacity, or otherwise deceives Attendees.
7.Content review, reporting & takedown
We may review, refuse, suspend, or remove any event at our sole discretion — before or after publication — and may suspend Host accounts. Anyone can report an event they believe is illegal or violates these Terms by emailing hello@pestakita.my.id.
As an Electronic System Operator, we will act on valid reports of prohibited content within the timeframes set by Permenkominfo 5/2020 (generally within 24 hours, and within 4 hours for urgent categories), which may include removing the event, suspending the Host, and freezing related payouts.
8.Payments, fees, payouts & refunds
- Ticket payments are processed via QRIS through our licensed payment partner (Xendit). PestaKita charges a 5% platform fee per ticket sold.
- Net proceeds are paid out to the Host’s designated account. We may delay, withhold, or reverse a payout where we reasonably suspect illegal activity, fraud, chargebacks, or a breach of these Terms, or where required by law or a competent authority.
- Refunds are the Host’s responsibility. If an event is cancelled, Attendees are entitled to a refund of the ticket price. Service/processing fees may be non-refundable to the extent permitted by law.
9.Disclaimers, liability & indemnity
The Platform is provided “as is”. To the maximum extent permitted by law, PestaKita is not liable for any event, the conduct of any Host, venue, or Attendee, or any loss, injury, or damage arising from attending or hosting an event.
The Host agrees to indemnify and hold PestaKita harmless from any claim, loss, fine, or liability (including legal costs) arising from the Host’s event, the Host’s breach of these Terms, or the Host’s violation of any law.
10.Law-enforcement cooperation & data
We log account, transaction, device, and contact data (including timestamps and IP addresses). We may preserve and disclose this data to the police, tax authorities, or other competent authorities where required by law or to investigate suspected illegal activity. 11.Suspension & termination
We may suspend or terminate any account that breaches these Terms or the law, with or without notice, and may cancel affected events and withhold associated funds pending investigation.
12.Governing law & disputes
These Terms are governed by the laws of the Republic of Indonesia. Any dispute that cannot be resolved amicably shall be submitted to the District Court (Pengadilan Negeri) of Bandung. An Indonesian-language version of these Terms prevails for the purpose of Indonesian law (Law No. 24 of 2009).
